Child maintenance
You can claim 💶 money (maintenance) for your underage child from the other parent.
There are two ways to do this:
1. A normal procedure at the family court.
2. A simpler and faster procedure — the “simplified procedure”.
For the simplified procedure, you must complete and submit a 📋 form.
This procedure is often quicker and costs less money than the normal procedure.
At the end, you will receive an official document that you can use to claim maintenance.
It is important that you speak to a ⚖️ lawyer or the youth welfare office beforehand. They will tell you whether this procedure is right for you.
💡Tip: The staff at the Youth Welfare Office (Jugendamt) are on hand to help single mothers and fathers with maintenance issues and help to enforce justified claims. The advice is free of charge.
- Karlsruhe Local Court
- Local Court Karlsruhe-Durlach
the local court (family court) in whose district the child or the parent representing the child usually resides.
✔️ It concerns maintenance:
- for a minor child or
- for a child of full age for the past period of minority.
✔️ The court has not yet initiated court maintenance proceedings.
✔️ No other court has already ruled on the maintenance claim.
✔️ There is not yet an enforceable maintenance title (e.g. a youth welfare office certificate).
✔️ The requested maintenance for the child is not higher than 1.2 times the minimum maintenance.
✔️ You are entitled to assert the maintenance claim as the
- custodial parent with whom the minor child lives, or
- the person or body legally representing the child.
